The article presents a vision of the challenges to which contemporary legal positivism has to respond. The constitutionalisation that governs current legal systems offers a new framework in which to develop the classic controversy between positivism and iusnaturalism. This article analyses the different positivist proposals put before the reality of the constitutional state as well as its replies to the criticisms of those who consider it anoutdated theory of little use. Finally, it will also deal with the relationship between positivism (...) and legal realism. This relationship is increasingly close due to the uncertainty that characterizes no few legislative and constitutional clauses. (shrink)

Qué hacemos para reparar a las víctimas, hacer justicia, acabar con la impunidad y por la construcción de la memoria histórica. En la mayoría de países democráticos el conocimiento del pasado, así como la reparación y justicia para las víctimas de períodos represivos, son parte de los cimientos del propio sistema. Por el contrario, en el caso de España, la debilidad de la democracia tiene su raíz en la impunidad de la dictadura, el abandono de las víctimas y la ausencia (...) de políticas de memoria. Hablar de memoria histórica no es una vuelta al pasado: es una necesidad del presente, pues no seremos una democracia plena sin antes reparar y dignificar a las víctimas. Casi cuatro décadas después de la muerte de Franco, queda mucho por hacer. La insuficiente ley de memoria histórica, las vías judiciales abiertas, la acción del movimiento ciudadano; y la responsabilidad de los distintos agentes políticos y sociales, centran nuestras propuestas para construir una memoria democrática. La idea de que la fenomenología de Husserl representa una suerte de filosofía reflexiva, basada en una metodología que desarrolla la tradición cartesiana, se ha convertido en una creencia ampliamente difundida en la literatura filosófica. Este énfasis puesto por Husserl en la reflexión fue arduamente criticado por Heidegger. Desde entonces resulta frecuente encontrarse con la afirmación de que Husserl y Heidegger desarrollan dos conceptos de fe-nomenología diferentes, incluso antagónicos. No se trata de seguir alimentando esta discusión historiográfica. Aquí, por una (...) parte, se muestra el núcleo de la temprana crítica heideggeriana en el transcurso de sus primeras lecciones de Friburgo y Marburgo y, por otra, se sopesan algunas de las observaciones críticas de Heidegger a Husserl a la luz de evidencias textuales de la fenomenología husserliana, ignoradas no sólo por Heidegger, sino también por un sorprendente número de reconocidos especialistas en el campo de la filosofía, de las ciencias cognitivas y de la filosofía de la mente.The idea that Husserl’s phenomenology is a kind of reflective philosophy inspired by the Cartesian tradition has become a common-place in the philosophical literature. Heidegger was one of the first thinkers who criticized the Husserlian emphasis on reflection. Since then it is easy to find the affirmation that Husserl and Heidegger developed two different, even antagonistic concepts of phenomenology. Here is not the place to continue embracing this discussion. One the one hand, the present article shows Heidegger’s early criticism developed in the course of his first lectures in Freiburg and Marburg. On the other hand, it weighs up some of Heidegger’s critical remarks regarding the reflective nature of Husserlian phenomenology in the light of important textual evidences ignored not only by Heidegger, but also by a surprising number of specialists in the fields of philosophy, cognitive sciences, and philosophy of mind. Este trabajo tiene por objeto investigar desde un punto vista histórico filosófico las consecuencias políticas de la separación entre la razón y la fe en el pensamiento de Marsilio de Padua. En él se explora la crisis que produce la aceptación irrestricta de la metafísica de Aristóteles, autor a partir del cual Marsilio realiza su análisis de la civitas, y algunas de sus consecuencias inmediatas en la filosofía política y el orden jurídico social de su tiempo: el uso de la (...) razón pura como instrumento exclusivo de análisis social, la separación de la ley humana de la ley eterna, y la búsqueda y consecución del bien común inmanente por sobre el trascendente, antecedentes que conforman el inicio del llamado liberalismo político. A modo de conclusión, se intentará demostrar que algunos de los postulados básicos que caracterizan el pensamiento liberal político moderno se encuentran virtualmente precontenidos en el pensamiento de este filósofo medieval. This work aims to investigate from a historic and philosophical point of view, the political consequences of the break up between faith and reason in Marsilius of Padua’s thought. It’s explored the crisis generated by the unrestricted acceptance of Aristotle’s metaphysics, from whom Marsilius raises his analysis of the civitas, and some of the immediate consequences in the political philosophy and the legal social order of his time: the use of pure reason as an exclusive instrument of social analysis, the separation of the human law from the eternal law, and the research and attainment of the immanent common good over the transcendent one, a background that builds the so called political liberalism. As a way to conclude, we’ll try to demonstrate that some of the basic premises that distinguish the modern liberal thought are virtually pre-held in Marsilius of Padua’s philosophy. (shrink)

Several studies have approached sense perception in the encyclopaedias of Thomas of Cantimpré, Bartholomew the Englishman and Vincent of Beauvais. Yet a systematic overview and comparison of the arrangement of sense perception in these encyclopaedias is still lacking. The overview offered here shows that all encyclopaedias place sense perception beside expositions on psychology and anatomy. There are, however, significant differences in how they treat the objects of sensation. In the case of Bartholomew and Vincent, I argue, these differences reflect two (...) different readings of Aristotle. (shrink)

We undertake the comparison between Ludwig von Bertalanffy's General Systems Theory and Alexandr Bogdanov's Tektology as two theories proposing a holistic interpretation of reality and claiming to solve problems which are unsolvable via conventional philosophic and scientific theories and methodologies. Basic misunderstandings by some Soviet authors regarding the nature of these theories -- especially in the case of Tektology -- are pointed out. The comparison is made in what concerns the general origins and purposes of the theories, their approaches to (...) the problem of organization, their treatment of mathematics and their understanding of the cybernetic concept of regulation. We contend that Tektology contains -- some 15 years earlier -- all the basic concepts which will be later developed by the General Theory of Systems. As we shall see, Tektology is the ultimate expansion of any theory of systems. This fact is widely ignored in contemporary specialized literature. We finally contend that both Tektology and the General Systems Theory are a sign of the times. A holistic secular monism is a respectable alternative to the failure of contemporary science and philosophy in guiding the life of men, in providing a raison d'être for human existence. However, we do not explore the soundness of this alternative. (shrink)

This paper presents an experience in developing professional ethics by an approach that integrates knowledge, teaching methodologies and assessment coherently. It has been implemented for students in both the Software Engineering and Computer Engineering degree programs of the Technical University of Madrid, in which professional ethics is studied as a part of a required course. Our contribution of this paper is a model for formative assessment that clarifies the learning goals, enhances the results, simplifies the scoring and can be replicated (...) in other contexts. A quasi-experimental study that involves many of the students of the required course has been developed. To test the effectiveness of the teaching process, the analysis of ethical dilemmas and the use of deontological codes have been integrated, and a scoring rubric has been designed. Currently, this model is also being used to develop skills related to social responsibility and sustainability for undergraduate and postgraduate students of diverse academic context. (shrink)

Two systems of belief change based on paraconsistent logics are introduced in this article by means of AGM-like postulates. The first one, AGMp, is defined over any paraconsistent logic which extends classical logic such that the law of excluded middle holds w.r.t. the paraconsistent negation. The second one, AGMo , is specifically designed for paraconsistent logics known as Logics of Formal Inconsistency (LFIs), which have a formal consistency operator that allows to recover all the classical inferences. Besides the three usual (...) operations over belief sets, namely expansion, contraction and revision (which is obtained from contraction by the Levi identity), the underlying paraconsistent logic allows us to define additional operations involving (non-explosive) contradictions. Thus, it is defined external revision (which is obtained from contraction by the reverse Levi identity), consolidation and semi-revision, all of them over belief sets. It is worth noting that the latter operations, introduced by S. Hansson, involve the temporary acceptance of contradictory beliefs, and so they were originally defined only for belief bases. Unlike to previous proposals in the literature, only defined for specific paraconsistent logics, the present approach can be applied to a general class of paraconsistent logics which are supraclassical, thus preserving the spirit of AGM. Moreover, representation theorems w.r.t. constructions based on selection functions are obtained for all the operations. (shrink)

Últimamente se ha producido una copiosa traducción de textos de Hei-degger. Ante la complejidad de sus expresiones, es necesario un trabajo de revisión y unificación de los términos castellanos. Con el ánimo de abrir un proceso de diá-logo entre los traductores, expondremos brevemente algunos puntos en los que se ejemplifica el problema. Por un lado, se trata de mostrar las tareas de traducción todavía pendientes de Ser y tiempo, a pesar de las dos traducciones existentes. A tal efecto se realizan (...) una serie de calas de pasajes, tanto de la versión de Gaos como de la de Rivera, ofreciendo en cada caso las propias sugerencias de traduc-ción. Y, por otro lado, se expone a discusión un elenco de términos que todavía están pendientes de una traducción definitiva.In recent times, there has been a lot of translation of Heidegger's texts. The complexity of his philosophical expressions and the diversity of translation solu-tions offered so far need to be unified. In order to open a dialogue among transla-tors we would like to expose briefly some examples that illustrate the problem of translation. On the one hand, we show that the task of translating Sein und Zeit is not yet finished, despite the translations of Gaos and Rivera. We take under consid-eration some quotes from Gaos's and Rivera's versions, offering in each case our own translation suggestion. On the other hand, we bring up for discussion different Heideggerian terms whose translations are still problematic. (shrink)

O presente artigo tem como objetivo refletir sobre as concepções comuns acerca do uso de drogas e seus usuários, compreendidos na atualidade como portadores de uma “doença”: Dependência Química; e ainda sobre os tratamentos voltados a este público. Na reflexão que propomos, recorremos às tematizações realizadas por Martin Heidegger, uma vez que este filósofo, através da sua analítica do Dasein, desenvolveu uma compreensão de homem para além da cisão dominante que o representa como um sujeito encapsulado, apartado do mundo, com (...) determinações prévias. Através da suspensão do que comumente se diz sobre o uso de drogas, buscamos compreender tal uso a partir do horizonte histórico em que ele se dá, cuja cadência dominante em nossa época, é a da máxima produtividade, do controle, da dominação, da exploração. É o que Heidegger se refere como a Era da Técnica, marcada por modos de ser compulsivos. Essa forma técnica de desvelamento do mundo, presente nas abordagens tradicionais científicas, reduz o homem apenas aos seus aspectos utilitários, perdendo de vista sua indeterminação originária e restringindo-o exclusivamente ao modo de ser técnico. Deixa assim escapar, aquilo que é mais essencial na compreensão dos fenômenos humanos a dimensão da própria existência. (shrink)

Throughout history, the public space in different towns and cities has been characterized by welcoming and favoring social and cultural encounters and exchanges. In turn, these urban fabrics have served to promote revolutions, changes, and social improvements. In the west countries case, the urban revolution has turned into a territorial expansion of democracy. Thus, structural social changes demanded by society have started from the squares and streets of numerous cities. Changes, which in many cases have been a real change. But (...) what happens when the vindication, fight or even revolution started from squares and streets serves to reverse all the democratic advances achieved This article analyzes the social demand phenomenon for independence in the Basque urban environments during the years 1969-2011. To do this, the methodology used is based on the academic and field review, characterizing the actions of independence and terrorism from an urban context through graffiti, murals, posters, and demonstrations. Thus, the neutrality of the public space progressively has been diminishing in the Basque urban environment until appropriating it. These aspects began to take relevance at the beginning of democracy. (shrink)

This article offers a new reading of Heidegger's thesis of the animal in The Fundamental Concepts of Metaphysics. Framing Heidegger's text through a brief analysis of Protagoras' genetic story of nature and of man's nature in Plato's eponymous dialogue, our reading brings out three key elements common to both texts: living nature as a normative rather than a physical order, the poverty of man's world in relation to the animal, and the attempted redemption of the latter through the acquisition of (...) Weltbildung. Staying with the way Heidegger brings out man's poverty in world in the text allows us (i) to undo once for all the oft-repeated charge of Heidegger's anthropocentric interpretation of the animal, (ii) to stage the hypothesis that philosophy and the life sciences of his day draw upon a common basic experience of the autonomy of life in relation to everything human, all-too-human, and (iii) to demonstrate the normativity and poverty of life. El renacimiento cultural del s. XII es producto de una serie de circunstancias que se pueden sintetizar en tres factores: el desarrollo económico, la expansión demográfica y el apogeo urbano. Dichas circunstancias parecen mostrar la decadencia del sistema feudal y la apertura a la sociedad moderna. Al resurgimiento literario y filosófico le acompaña el metodológico. La lógica aristotélica se convertirá en instrumento necesario tanto en los debates teológicos como jurídicos. Ya no presidida por el viejo esencialismo o la inmanencia griega, (...) se convertirá en técnica imprescindible para una sociedad que muestra una clara mentalidad ciudadana y mercantil. (shrink)

The present chapter sketches the adoption of logic in late nineteenth and early twentieth century China. Addressing both conceptual and institutional aspects of this process, it contextualizes the raising interest in the discipline among Qing scholars and Republican intellectuals. Arranged largely chronologically, it delineates the successive periods in the reception of major works of and intellectual trends in the field. It introduces the most influential scholars promoting a public discourse on logic in the final years of the empire, but also (...) the ever more professional agents who participated in the ensuing establishment of a modern institutional framework for studies in logic like universities, departments of logic, academic societies, journals etc. While at the beginning, these people were mostly no trained logicians, progress in the establishment of academic logic in the 1930s provided the conditions for the formation of the first Chinese specialists in the field who were often internationally trained and soon to engage in cutting-edge research. In some contrast, academic discourse on logic well into the 1930s was dominated by exaggerated social and political expectations, not least due to the successive influence on intellectuals of inductionist scientism in the first decades of the twentieth century, of an inflated pragmatist notion of logic in the 1920s, and of an overly simplistic “antiformalist” notion of logic propagated by (vulgar-)Marxist historical dialecticians in the 1930s. The arrival of scientific logic also went in tandem with a renewed interest in studies in the traditional Buddhist “science of reasons” (yinming, hetuvidyā, “Buddhist logic”) and spurred the search for contributions to the field of logic in the record of inherited Chinese literature, a development which soon led to the common acceptance of the existence of genuinely Chinese traditions of logic. It is eventually a peculiarity of the Chinese reception of logic that since around 1920, less than two decades after the first modern translations of textbooks on traditional syllogistics, the visit of Bertrand Russell – one of the fathers of mathematical logic – fueled the spread of this new approach to logic which has eventually changed its face for good. Designed as a historical survey, this chapter is a general account on the major contributions to the field by Chinese scholars of the time and has to forego detailed discussions. (shrink)

A strange dialectical reversal characterizes the oppositions which psychoanalysis posits against philosophy and neuroscience: what psychoanalysis intervenes with as a unique and missing quality of these subjects, reveals itself upon enquiry as already having been a feature of said subjects. This article first discusses the failed intervention of psychoanalysis within the perceived totalities and absolutes of German idealism. Psychoanalysis, founded on an ontological division and internal inconsistency with a retroactive logic, finds this internal contradiction already reflected within the supposed totalities (...) of Schelling and Hegel. Schelling’s “blind act,” a decision with no prior foundation that grounds an abstract identity-in-itself, appears as the counterpart to what Badiou calls the strictly “analytic act.” Hegel’s Science of Logic, in which the inconclusive interpenetration of being and nothing presupposes its own conclusion in the transitions to essence, and in which an internal incompleteness and contradiction are retroactively constitutive of the concept, similarly nullifies the intervention of psychoanalysis. Finally, precisely such a reversal is presented in neuroscience, where the constitutive contradiction of contingently functional neuronal formations in the adaptive “multiple demand” model of executive functioning repeats the contingent and self-contradicting psychoanalytic subject as being its own deference within linguistic, discursive formations. This article investigates conceptual and strategic relationships between corporate identity, organizational identity and ethics, utilizing the Benetton Corporation as an illustrative case study. Although much attention has been given to visual aspects of Benetton's renowned ethical brand building efforts, few studies have looked at how Benetton's employees, retail environments, and trade events express ethical aspects of their well-known corporate identity. Operational identity emerged as a useful complement to models of corporate identity. A multi-method case study, including interviews at retail outlets (...) and trade events, sheds light on several important yet under-studied components of corporate identity, including stakeholders such as retail managers and contract employees. Analysis of Benetton's operations revealed disconnection and inconsistency, as well as a failure to communicate ethical values and socially responsible attributes throughout organizational identity. We demonstrate the way in which organizations may fail to capitalize on positive aspects of their organizational identity by neglecting their operational identity. (shrink)

I argue that the hospitality of the foreigner for Heidegger is the condition of possibility of dwelling understood as the happening of history.In the first section I analyze the notions of hospitality in Levinas and Derrida. The second section unpacks some of the senses of the earth in (...) Heidegger as the site of man’s historical dwelling, whereas in the third section I focus on holy mourning as the disposition that reveals the earth as the uncanny ground of history. In the final section, I spell out Heidegger’s conception of hospitality, the greeting, and the foreign guest. (shrink)

O objetivo deste artigo consiste em analisar como Nietzsche, baseado na filosofia schopenhauriana, resolveu o problema do surgimento da tragédia grega através da elevação dos elementos Apolo e Dionísio a um estatuto ontológico, e como os gregos fizeram isso em seu tempo através da Música, além de revelar como, em Nietzsche, o pensamento de Sócrates surge como o “perverso algoz da arte”.O estudo foi realizado através de uma pesquisa bibliográfica com base nas seguintes obras do filósofo: A visão Dionisíaca de (...) Mundo e O nascimento da tragédia no espírito da Música. Na segunda parte, sugere-se como Nietzsche faz esse resgate do trágico em sua época e qual a recepção no século XIX de seu trabalho. (shrink)

Effective corporate social responsibility policies are a requirement for today's companies. Policies have not only to be formulated, they also have to be delivered by corporate employees. This paper uses existing research findings to identify two types of factors that may impact on employee motivation and commitment to CSR ‘buy-in’. The first of these is contextual: employee attitudes and behaviours will be affected by organizational culture and climate, by whether CSR policies are couched in terms of compliance or in terms (...) of values, and by whether such policies are integrated into business processes or simply an ‘add-on’ that serves as window-dressing. The second set of factors is perceptual. Motivation and commitment will be affected by the extent to which they can align personal identity and image with that of the organization, by their perceptions of justice and fairness both in general and in terms of how CSR performance is rewarded, and by their impressions concerning the attitude of top management to CSR issues and performance. Una mujer joven y animosa, que llegó a UNICEF tras una larga trayectoria de éxito profesional pero también de aventuras como voluntaria alrededor del mundo� Me pregunto, sin embargo, si realmente estas organizaciones son eficaces en países como España, el los que la infancia no parece malnutrición y parece estar bien atendida en todos los aspectos. The objective of this work is to carry out a genetic study on the Husserlian concept of noema based in the givenness of the real body in the passive experience of pain. The development focuses, either, on the delimitation of the painful body given in its physical sphere in attention to its material properties, and in the eventual integration of this passively given body in the so-called noetic-noematic structure regarding the intentional revelation that pain implies. To do this, pain will (...) first be briefly examined in light of "original" passivity. Secondly, the way in which the body is given in its real disposition and its understanding as a bodily ego in experiencing pain will be contemplated. Thirdly, considering the “original” constitution of the body in pain in a broad sense, emphasis will be placed on its correspondence with intentionality, a matter that only confirms that pain is a form of perception. Finally, the deployment of the genetically viewed noema is given on the basis of the determination of the real body as a noematic object. (shrink)
